Litigation & Advisory

Plaintiff

The plaintiff is the person who initiates a lawsuit and seeks a decision. They must formulate what they claim and explain on which facts and rules their request is based. The term describes their procedural position, without presuming they are right.

To prepare a file, precisely identify the plaintiff, the person targeted, and the object of each request. A company acts under its own identity with the required representation. The documents must allow linking the claims to this person and the concerned dispute, rather than to an activity or a broadly described group.

The request must also distinguish what is sought: obtaining a payment, having a right recognized, or requesting a provisional measure. The narrative of the dispute does not replace the identification of the sought result; it is this result that structures the claims submitted to the judge.
