Civil & Commercial Litigation

Jurisdictional Competence

Jurisdictional competence determines which cases a court can examine. It requires identifying the right court before filing a claim. The nature of the dispute and its territorial connection must be examined according to applicable rules.

In a Luxembourg file, start by qualifying the claim: work, civil or commercial recovery, social security, administrative decision. Add the parties' contact details and relevant locations. A clause in a contract also deserves verification; it should not be considered sufficient without examining the concerned regime.

An error in jurisdiction is not resolved by merely changing the address on the correspondence. The form of referral, representation, and deadlines may also vary. The choice of court therefore precedes the preparation of the introductory act.
