Application to the court
The application is the form taken by certain requests addressed to a court. The content and filing depend on the chosen procedure. The term does not designate a universal form allowing any court to be seized.
Before filing an application in Luxembourg, check the jurisdiction, necessary mentions, documents, and the number of copies required. Clearly present the object and amounts when they need to be quantified. A letter recounting the facts without an identifiable request may not meet the applicable requirements. Keep proof of the filing made.
The application and the summons are two different forms of seizing. The choice does not depend on a preference for presentation: it results from the applicable procedure. Verify this point before preparing a form or transmitting documents to the court.
