Employment & Labor Law
The medical certificate of incapacity certifies the employee's condition and the foreseeable duration of their absence. Its issuance, content, and transmission are subject to deadlines. In Luxembourg, the sections and recipients must be verified to meet obligations towards the employer and the CNS.
For the employee, the employer must be notified from the first day of absence; the certificate must reach them no later than the third day. The sending to the CNS follows its own modalities, especially for weekends and public holidays. The two recipients must therefore be followed separately.
A certificate issued is not necessarily a certificate received on time. Keep proof for each sending and check the start and end dates. During an extension, avoid assuming that the first document covers the new period. The CNS modalities must be consulted in their current version.
