Employment & Labor Law
Incapacity for work corresponds to a health condition temporarily preventing the employee from performing their work. It must be justified according to the applicable procedures towards the employer and the social security body. Informing the employer and sending the certificate to the CNS are two distinct obligations.
Keep proof of transmission and verify the period covered by each certificate, especially in case of extension. A declaration made to one body does not automatically prove that the other recipient has been informed. The consequences on remuneration and protection against dismissal must be examined separately.
The file must allow reconstructing the absence periods without unexplained gaps: first certificate, extensions, and resumption. This chronology helps to handle exchanges with the employer and the CNS. Temporary incapacity should not be assimilated to a decision of professional redeployment.
