Employment & Labor Law
External professional redeployment aims at reintegrating an employee into the labor market who can no longer hold their last position for health reasons and who could not be redeployed within their employer. It is distinct from the recognition of a disability.
Redeployment is part of a medico-administrative procedure and a decision by the Joint Commission. It does not result from a mere declaration of difficulty in working. Access conditions must be checked in the medical and professional file; an ordinary work stoppage does not, by itself, grant this status.
To prepare the file, keep the decisions received, elements related to the position, and exchanges with competent bodies. It is necessary to understand the exact scope of the decision, the steps with ADEM, and the conditions of any benefits. A sick leave, unfitness for the position, and external redeployment do not automatically produce the same effects.
