Maternity Leave

Maternity leave protects the period before and after childbirth. In Luxembourg, prenatal leave normally starts eight weeks before the expected date of delivery and postnatal leave lasts twelve weeks. A birth before or after the expected date modifies the schedule according to applicable rules.

The Guichet sheet provides for a mandatory affiliation condition to health-maternity insurance for at least six months during the twelve months preceding the start of the leave. The certificate indicating the expected term must be issued in the last twelve weeks of pregnancy and sent to the concerned recipients.

In practice, check the date of the certificate and prepare the procedures with the CNS and the employer. If parental leave is to follow, its own application schedule must be anticipated. The presumed date of birth, the actual birth, and the start of leave are three distinct markers that must be kept in the file.
