Employment & Labor Law
Extraordinary leave allows the employee or apprentice to be absent on the occasion of certain personal events provided for by Luxembourg rules. Marriage, a birth, or the death of a close relative can notably open a right whose duration depends on the event and, sometimes, the family link.
For example, the legal regime provides three days for the employee's marriage and one day for the declaration of partnership. Other events follow their own durations and conditions. An absence for family emergency or to provide medical assistance should not be treated as ordinary annual leave.
To request this leave, inform the employer and prepare the appropriate justification. Precisely identifying the event, its date, and the link with the concerned person avoids a misqualification. This leave is distinct from annual leave, parental leave, and leave for family reasons. Also check applicable collective agreements when they provide more favorable rights.
