Employment & Labor Law
Length of service measures the duration of the professional relationship considered for a specific right. In terms of notice of dismissal in Luxembourg, the ITM indicates that it is assessed on the day of dismissal. Its calculation may require examining continuous services within a group.
The date of the last signed contract is therefore not always sufficient. Gather successive contracts, amendments, and documents relating to a possible transfer or change of employer. Also, check which right you are calculating: reference rules should not be transposed without examining one scheme to another.
A calculation of length of service must thus include two visible dates: the start of the period considered and the date on which the right is assessed. This presentation allows verification of crossing a threshold without confusing length of service, notice period, and last working day.
