Notice of Dismissal

The notice of dismissal is the period during which the contract continues after the decision to terminate, according to a schedule set by Luxembourg law. For a CDI outside the probationary period, its legal duration depends on seniority: two months before five years of service, four months between five and less than ten years, six months from ten years. More favorable provisions or a particular regime may modify the analysis.

The day of notification does not necessarily constitute the first day of the notice. A notification before the 15th in principle leads to a start on the 15th of the month; a notification from the 15th postpones the start to the first day of the following month. Proof of sending or delivery must therefore be kept.

A work exemption does not automatically remove remuneration. The compensatory notice indemnity and the severance indemnity answer, moreover, two distinct questions. To check a balance, examine separately the schedule, the amounts due, and the contestation deadlines.
