Employment & Labor Law
Resignation with notice is the employee's decision to terminate their contract after a period. For a Luxembourgish permanent contract outside the trial period, the legal notice is one month before five years of seniority, two months between five and less than ten years, and three months from ten years. This scale differs from that of dismissal.
Before notifying the decision, check the date of entry into service, the contract clauses, and the applicable schedule. A request for early departure must be distinguished from the resignation itself: it requires examining the conditions of the obtained agreement.
