Civil & Commercial Litigation

Debtor

The debtor is the person obliged to fulfill an obligation to a creditor, notably to pay a sum. This role must be linked to the contract or the fact that created the debt. It does not allow automatically equating a company with its director.

When you receive a payment request, verify the targeted identity, the origin of the sum, the due date, and the payments already made. If you contest, clearly indicate the concerned items and the documents supporting your response. A judicial procedure received requires a distinct examination from simple amicable exchanges.

A partial contestation deserves a breakdown that separates recognized sums and disputed items. This distinction facilitates reading the file without presuming the outcome of the dispute. Keep together the received request, your response, and proof of payments.
