Civil & Commercial Litigation
The creditor is the person holding a claim. It can be an individual, a company, or an organization. Their status must be established: the person claiming payment must be able to explain why it is due to them.
Before a recovery action, verify the exact name, any company changes, and the existence of a claim assignment or mandate. This avoids confusing the right holder with their representative. In exchanges, present a readable breakdown and relevant documents rather than a simple assertion of debt.
If a third party intervenes to claim payment, ask in what capacity they act. The mandate to recover and the transfer of the claim are two different situations. This verification notably allows identifying to whom a payment should be addressed.
