Civil & Commercial Litigation
The objection is the procedure by which the debtor contests a conditional payment order, explaining why all or part of the claimed amount is not due. It is filed with the court registry according to the applicable procedural rules.
Prepare specific reasons: payment already made, error in amount, contested service, or other documented objection. A simple protest addressed to the creditor should not be presumed equivalent to the required objection. Check the jurisdiction and the deadline indicated on the received document, then keep proof of the procedure.
Before the justice of the peace, the debtor has thirty days after the notification of the order to file an objection. After this period, it remains possible as long as the title has not been made enforceable. This residual possibility does not justify waiting: the exact state of the procedure must be verified with the registry.
