Employment & Labor Law
Overtime is a working hour that falls under the regime of exceeding the normal applicable duration. In Luxembourg, its compensation may take the form of rest or, under the provided conditions, increased payment. The ordinary regime provides for one and a half hours of rest for one overtime hour or increased remuneration of forty percent when payment is required.
First, establish the hours actually worked and their qualification. A positive badge balance does not resolve all questions: schedules, reference period, employer's request, and employee's status count.
Increased payment occurs notably when rest compensation is not possible or upon departure before recovery. Certain statuses, including senior executives in the legal sense, require particular examination. The job title alone does not suffice to determine the regime of each hour.
