Exequatur refers to the judicial authorization allowing the enforcement in Luxembourg of a foreign decision or arbitral award when such a procedure is required. Its examination depends on the country of origin, the subject matter, and the applicable circulation regime.
Before enforcing a foreign title, gather the complete decision, the documents relating to its notification, and information on appeals. Do not assume that every decision requires the same formality: some international or European frameworks organize different modalities. The objective is to identify the correct mechanism before incurring enforcement costs.
The recognition of a decision and its material enforcement meet two different needs. A recognized decision does not, by itself, reveal the assets allowing recovery. It remains to prepare the steps corresponding to the sought measure in Luxembourg.
