Legal Costs
Legal costs constitute a category of expenses incurred by the trial, such as certain act or expert fees. They do not necessarily cover all the expenses a party incurs to defend their interests.
To assess the cost of litigation in Luxembourg, distinguish legal costs, agreed attorney fees, and any procedural indemnity. Request a budget separating these items and the stages of the procedure. A condemnation of the opponent to legal costs should not be understood as a guarantee of full reimbursement of all your expenses.
The judgment must be read on each of these items. Winning on the main issue does not mean that all incurred expenses have been charged to the opponent. A separate account allows tracking the costs actually recoverable in light of the decision.
