Employment & Labor Law
The employee representative represents employees within the framework of the missions provided for by Luxembourg law. Their mandate comes with specific protection, particularly against dismissal. This protection does not mean that no legal proceedings are possible in the presence of serious facts.
To analyze a situation, check the status of holder or substitute, the dates of the mandate, and, if applicable, those of the candidacy or the end of functions. Remedies and deadlines differ from those of an ordinary dismissal. A received letter must therefore be immediately examined in light of the exact status.
The protection does not only concern the representative in office: certain periods following the mandate or surrounding a candidacy are also protected. Dates must therefore be compared to the received document. The suspension of a representative calls for a specific examination, distinct from the ordinary regime.
