A penalty payment is an amount intended to compel a person to fulfill an obligation imposed by a court decision. It can be calculated based on a period of delay. Its role is coercive; it is not to be confused with the compensation for the main damage.
To understand a penalty payment, review the targeted obligation, the starting date, the calculation unit, and any limits set by the judge. Document the execution or delay. The mere amount announced in a letter is not sufficient to establish the actually payable sum.
The question to ask is concrete: what action does the judgment require, and from when will the delay be counted? Proof of payment does not demonstrate the fulfillment of an obligation to deliver a document or carry out work.
