Appeal of a judgment

An appeal allows a higher court to re-examine a case judged in the first instance, under the conditions provided for the dispute. The examination may concern facts and law. It is distinct from a cassation appeal.

In Luxembourg, it is necessary to identify the decision, the available appeal route, and its deadline before acting. Keep the complete judgment and its proof of notification or service. Disagreement with the result is not enough to determine the procedure to follow: the matter and nature of the decision count.

The first check concerns the very possibility of appealing: not all decisions follow the same path. Appeal and cassation do not have the same purpose; the latter controls the application of the law and does not constitute a new trial of the facts.
