Declaration of bankruptcy
The declaration of bankruptcy is the procedure by which the trader or the competent representative of a company declares its situation to the court for the opening of bankruptcy. It is accompanied by the required information and documents.
The legal deadline must be examined from the cessation of payments, with any applicable special rules. Negotiations with creditors do not allow assuming that this obligation is suspended. The opening judgment remains a court decision.
