You live in France, Belgium or Germany and your Luxembourg employment ends. To prepare an unemployment application, distinguish Luxembourg documents from the application to the institution that will assess entitlement. The last place of work does not, by itself, determine where benefits are paid.

Identify the competent country

For a cross-border employee in the situation of complete unemployment described by ADEM, benefits are claimed in the country of residence. Additional registration with ADEM does not transfer payment responsibility to it. The amount and duration are governed by the competent country’s rules. [1]

This guide concerns loss of employment. Short-time work, continuing employment or a particular residence situation requires a separate assessment. Describe your actual circumstances before applying the ordinary cross-border worker procedure.

What is the U1 form for?

The U1 certifies employment periods completed in Luxembourg. According to ADEM, the employer completes the certificate of termination of employment relations; the competent ADEM department then issues the U1 on that basis. It is used to establish those periods before the institution in the country of residence. [1]

It is distinct from an ordinary employment certificate and from a decision awarding benefits. Check that you request the document corresponding to the unemployment procedure.

Prepare documents as soon as the contract ends

Gather the termination notice, contract, latest payslips and evidence of periods worked. Ask the employer to submit the information needed for the U1 and keep proof of your request. Check the dates when the document arrives.

In parallel, ask the institution in your country of residence about registration and filing the application. Do not wait passively for a document without checking whether a step must be taken meanwhile. National procedures and deadlines may differ.

Address inconsistencies and missing documents

If the stated end date or reason does not match your documents, request written clarification. Explain the difference and attach the relevant document. Do not alter an official certificate yourself.

If the employer fails to act or has ceased trading, contact the institutions, explaining steps already attempted and documents available. A documentary difficulty must be distinguished from disagreement over benefit conditions.

Does resignation create the same rights as dismissal?

The reason for loss of employment must be assessed under the competent country’s rules. Do not sign a negotiated termination assuming its effects are the same everywhere.

Does the U1 determine my benefit amount?

It certifies periods. The competent institution decides entitlement after assessing the applicable conditions.

KM Legal can assist with Luxembourg end-of-employment documents and coordination difficulties linked to departure, distinguishing the rules of the country assessing unemployment entitlement.
