Oral dismissal in Luxembourg: what to do if your employer tells you not to return
At the end of a discussion, your manager tells you to leave and not return. No letter is provided. Clarify the meaning of the words promptly and preserve evidence, without assuming the absence of a letter makes the situation inconsequential.
An oral termination raises issues of form and evidence
The ITM states that an oral dismissal is unfair. [1] However, where the employer denies having terminated the contract, it remains necessary to demonstrate what was announced. The employment law materials published by the ministry recall this evidential difficulty. [3]
The words spoken, their context and who used them matter. Being told to go home for the day, release from work, suspension and announcement of the contract’s end are not interchangeable. Record the exact words you remember rather than immediately replacing them with a legal classification.
Record facts while they are fresh
Write down the date, time, place, people present and course of the discussion. Keep messages received and documents provided. If access was disabled or your badge taken, record when and by whom, without trying to circumvent an access restriction.
- Who asked you to leave, and in what capacity?
- What words were used about continuation of the contract?
- Did a witness directly hear the exchange?
- Were instructions given for the following days?
- Does a later document or payment clarify matters?
Request written clarification
A factual message can recall the discussion and ask for confirmation of the situation and work instructions. Have its wording adapted if the context is contentious, particularly to avoid it being interpreted as resignation or agreement to terminate.
Example: after an interview, an employee receives only “please return the equipment”. This message should be kept, but assessed alongside the reported words and other exchanges. An isolated document does not necessarily resolve the question of termination and its date.
Avoid irreversible decisions in haste
Do not sign a voluntary departure or agreement you do not understand to “regularise” the situation. Keep copies of proposed documents. Likewise, seek advice about what to do regarding work rather than prolonging silence for several days.
The file should show your efforts to understand the situation. The aim is not to provoke another incident or multiply messages, but to leave a clear and proportionate record.
Have remedies assessed without waiting for a hypothetical letter
Guichet includes oral dismissal among unlawful terminations that may be challenged. [2] As the date and classification may be disputed, have deadlines and the appropriate procedure checked promptly. Waiting for a letter that never arrives can complicate the file.
Gather the contract, payslips, correspondence, your chronology and potential witnesses’ contact details. Amounts to claim and proof of termination must be assessed separately. KM Legal can help clarify the situation, preserve your rights and prepare useful steps.
Frequently asked questions
Without a letter, can I assume nothing happened?
No. Oral termination may have consequences and requires prompt assessment, particularly if the employer later denies the words used.
Does disabling access prove dismissal by itself?
It is contextual evidence to preserve, but must be considered with exchanges and other facts.
