Redeployment may allow you to continue working at a lower salary. The compensatory allowance must be assessed as an entitlement distinct from salary and the redeployment decision. To understand an amount or missing payment, identify the scheme, dates and remuneration taken into account.

Check the situation giving rise to an application

ADEM describes compensation for reduced pay in internal redeployment. For external redeployment, it concerns a person who finds a job under the prescribed conditions, including assignment by its services. The application must be filed within six months of the start of the new contract or amendment, even if some documents are still missing. [1]

Do not confuse this allowance with the professional waiting allowance, intended for another stage, or with an amount potentially owed by the former employer. Check the exact name on the application and decision.

Gather documents before comparing amounts

ADEM’s requested file includes, in particular, the former contract, new contract or amendment, declaration of fitness for the role and bank details. Further documents depend on the redeployment, including the final payslip or relevant collective pay scale. [1]

For your own checks, add payslips covering the transition, the redeployment decision, filing acknowledgement and requests for further information. An incomplete file and a refused application are different situations; establish the processing stage.

Compare consistent bases

For external redeployment, the ITM links calculation to the loss between pre-redeployment salary and salary under the new contract within the applicable statutory framework. It also recalls the conditions of assignment and fitness for the new role. [2] The individual calculation must therefore be compared with the data used by the administration.

To assess a difference, record the reference period, pay components, contractual hours and effective date. Compare gross with gross and distinguish salary, allowance, deductions and any arrears. The amount credited to a bank account alone does not reveal the whole calculation method.

Example: an initial payment seems lower than the expected monthly difference, but covers only part of the month. Before concluding there is an error, check the covered dates and whether a supplementary statement exists. This example illustrates a check, not a universal calculation formula.

Make a precise request for explanation

  • State the file reference and decision concerned.
  • Identify the month and item you wish to have checked.
  • Present your comparison with the corresponding payslips.
  • Ask which data were used and whether a document is missing.

Keep submissions and do not let a request for information replace assessment of a remedy if an adverse decision has been notified. Read its author, subject and challenge instructions carefully.

Follow changes after the award

A change of role, contract or status may require a fresh check. ADEM describes, in particular, the effect of withdrawing internal redeployment on compensation. [3] Report decisions received rather than assuming the amount will remain unchanged permanently.

KM Legal can compare contractual and administrative documents, identify the source of a discrepancy and assess the appropriate procedure in a disagreement.

Frequently asked questions

Should I wait for every document before applying?

ADEM states that filing must meet the six-month deadline even if the file still needs completing. Keep proof of filing.

Does the difference between two bank transfers equal the compensation entitlement?

Not necessarily. Periods, pay bases, deductions and arrears must be distinguished before comparison.
